中国案例监督与指导制度新论

当下之中国，采纳本源型的西方判例法制度受到宪政和司法体制限制且缺乏司法文化之基础，而走司法解释型的案例制度之路又存在理论上的误区及权力异化之危险。从司法管理、司法方法与审判程序制度相结合的视角，在现行案例指导制度基础之上，由最高司法机关统一建构司法方法性的管理制度，如案例监督与指导制度（简称“案例督导制度”）合法而可行，现实且必要。文章对案例监督与指导制度的内涵、实质、新颖性、合法性等问题进行了全新诠释，并从法理、司法方法和司法管理角度做了进一步阐述和论证。
