| 摘 要： | 本文从分析搜索引擎服务商在未经网页著作权人的许可利用网页快照,对网页进行复制、存储、允许网络用户对该复制的快照进行访问的相关行为的定性入手,考察其行为是否构成网页著作权侵权,传统的著作权抗辩事由是否可以继续运用,以及提出网页快照是否侵权不应一概而论,而应借鉴灵活开放的“合理使用”标准确立其存在的合法性的观点。

| Abstract: | This thesis analyzes from the judgment of the nature of the related behavior that the search engine service provider, uses the web caches, copies and stores the web pages, and allows the web users to access the copy snapshot without the permission of the eopyright owner of the web pages. At the same time, it examines whether this action infringes the webpage copyright or not, and whether the traditional grounds of opposition of copyright can be used continuously or not. The article also expresses that we should not lump all the judgments of whether one web cache infringes the copyright or not together. We should refer to the flexible and liberal standard of ＂reasonable use＂ to establish the opinion of its legal existence. |
