| 摘 要： | 第三人撤销之诉是我国新《民事诉讼法》的一项创新,但其在适用中存在诸多问题,尤其体现在对原告资格的界定上。对此,我国学者和实务界人士都有着不同的看法。与我国台湾地区《民事诉讼法》的相关规定进行比较后,认为第三人撤销之诉的适格原告,适用中应当对主体资格有所扩张,但在程序上要进行限制。

| Abstract: | The third party＇s cancelling suit is an innovation of the new Civil Procedure Law in China. But it has many problems in application, especially embodied in the definition of the plaintiff qualification. Chinese scholars and practitioners have different opinions about this. The Civil Proce- dure Law in Taiwan also has relevant regulation and discussion. The third party＇s in cancelling suit should expand the qualification, but also must carry on the limits on the procedure. |
