| 摘 要： | 针对我国受贿犯罪立法中存在的缺陷,在考察犯罪性质、犯罪动机的基础上,结合国内外的司法实践和司法理论,提出在受贿罪立法中,确立“权利与义务相对应”原则,适当扩大受贿对象的范围,调整受贿罪定罪标准。同时,提出应引入打击受贿犯罪的新机制,并比较分析了美国辩诉交易制度和中国“囚徒困境理论”各自的优劣。最后,提出建立立法与监督相结合的受贿犯罪预防机制,以提高司法效率。

| Abstract: | This paper intends to establish the principle of "rights conformed with duties",relevantly enlarging the sphere of bribe-taking and adjusting the standards of bribery regarding the drawbacks existing in the legislation of bribery.And puts forward the new system of curbing crimes of bribe-taking.This paper also compares American plea bargaining and China's prisoners' dilemma.Finally,this paper puts forward the notion of combining legislation and supervision towards crimes of bribery to uplift the judiciary efficiency. |
