公务员录用中基因歧视法律问题研究

摘    要:现行有关公务员录用体检的法律有条件地允许录用机关在体检中了解相对人的基因信息,但从比例原则的角度考虑,允许基因检测行为有违最小侵害和损益相称原则,应予立法明确禁止。对在体检时已知携带疾病关联基因的相对人,招录机关应以是否存在《公务员录用体检通用标准》法定之不合格事项作为判断其体检达标与否的唯一标准,不得仅以相对人的带因情况为由做出拒绝录用的决定。
