| 摘 要： | 诚实信用已由最初的道德规范发展成为现代民法的一个基本原则。诚实信用原则的实质就在于授予法官自由裁量权。在现代社会 ,依诚实信用原则授予法官自由裁量权 ,有利于克服立法滞后性 ,增强法律的稳定性 ;有利于调整社会生活中出现的各种利益关系 ;有利于促进当事人更好地守法 ,建立一种公平竞争、友好协作的信任关系。

In modern society, it can help overcome legislation lag, enhance legal stability, adjust all kind of advantage relationships in social life, boost party keep the law better and base relationship on fair competition and friendly cooperation. |
