浅议我国现行土地征收制度之缺陷

土地征收制度的设计直接影响其运行效果,土地征收制度的运行效果直接影响土地权利人的权益。土地征收制度本应该体现国家权力与公民权利的平衡,这在构建社会主义和谐社会中将发挥重要作用。然而我国现行土地征收制度由于理念和制度设计本身的原因导致在运行过程中有许多不尽如人意之处,文章着重分析这些缺陷与成因,以期对改革与完善我国土地征收制度起到对症下药之效。

On the Deficiencies in China' s Land Expropriation System

The design of land expropriation system directly affects its implementation,and the effect of the system implementation directly affects the benefits of land owners.Land expropriation system is supposed to represent the balance between state power and civil rights,which is playing an important role in constructing a harmonious socialist society.Due to problems in conception and system designs in the existing land expropriation in our country,there are a number of deficiencies in the implementation of it.This article makes analysis of these deficiencies and the cause of them,in hope of providing solutions in reforming and improving the land expropriation system in our country.
