| 摘 要： | 中国法家思想与实证主义法学分别是中西方比较有影响的法学流派,他们在法的实质、作用及法律和道德的关系等方面存在着一些异同点。通过二者的比较可以得到很多有益的启示。在我们向法治社会转型的过程中,这种比较具有积极的启发意义。

| Abstract: | Chinese legalist thought and western positivism law thought are influential schools of law in China and in the west respectively.There are some similarities and difference between them in the aspect of law essence,function,and the relation of law and the morality.We can get a great inspiration by a comparison between the Chinese legalist thought and western positivism law thought.The comparison is a positive inspiration to us in the process of transforming our society from ruling society to legal society. |
