| 摘 要： | 法律价值的内涵表现为多层级性,而我国有线电视法规的法律价值追求是单一的。当前有线电视的发展过程中出现了许多新情况、新问题,法律制度在建构时需要有新的突破。对有线电视法律制度的发展历程进行梳理和比较,认为追求社会稳定、保护公民利益、保障平等竞争是市场经济条件下有线电视法规的三种价值内涵,而公平(平等)的位阶高于安全和自由。但是。保障有序的经济竞争、保护消费者的利益正是目前我国有线电视法规所缺失的。随着形势的发展,保障有线电视的平等竞争具有更加积极的意义。

| Abstract: | The connotations of legal value can be shown in various layers.However,the legal value that domestic cable TV regulations pursue is single.Meanwhile,many new problems have arisen in the devel- opment of cable TV,so there must be breakthroughs when we are formulating pertinent regulations.By comparing the regulations in China with those in the USA,this paper concludes that the purpose of cable TV law is to pursue social stability,protect the citizens' rights and safeguard equal competition.Howev- er,the latter two goals are far from fulfilled considering the present cable TV law and regulations.With the development of time,the safeguard of equal competition is of a more positive significance. |
