| 摘 要： | 受西方启蒙思想影响 ,立足中国传统法律文化与清末特殊的政治形势 ,严复首倡赋予中国民众以平等权、自由权 ,倡导资产阶级的法治主义 ,强调立法权和司法权独立的重要性。这些思想 ,使严复成为中国近代最早的资产阶级启蒙法律思想家。

| Abstract: | Influenced by the enlightening thoughts of the West, basing on the Chinese traditional law culture and the special political situations in the late Qing Dynasty, Yanfu advocatded for the first time Chinese people's rights to equality and freedom and proposed the capitalist principle of administering the country by law. He also emphasized the importance of independent legislative authority and judicial power. All these thoughts owned him the first capitalist enlightening law thinker in modern China. |
