全球化与国际法的人本主义转向

国际法存在着以国家为主体、以国家利益为本位的传统。但是,由于20世纪以后出现的经济大规模跨国交往、国际危机与问题以及人权国际体制所带来的全球化趋势,国际法正在从“国本主义”走向“人本主义”。当前的国际法不仅已经出现了大量的人本主义规范,而且逐渐在整体上以人类利益和可持续发展作为价值取向。国际法的人本主义是实现国际法治的重要前提之一。

Globalization and the Shift of International Law to Humanism

The tradition of international law is that states are exclusive subjects,and all rules are served for state interests.In the second half of the 20th century,the trends of human rights which is internationalized and globalized set forth by large scale of transnational economic transactions make international law shift from "state-centered approach" to humanism.The contemporary international law has not only created a great deal of humanistic rules,but also established the values of human interests and sustainable development for all the people in the world.The humanism of international law is a key feature to realize international rule of law.
