| 摘 要： | 曾经存在于纳西族社会中的大量 "情死"(殉情)现象是一种非正式制度.通过对纳西族的"情死"发生的考察,将揭示非正式制度的产生与法律紧密联系.如果法律规定了惟一"正确"的生活方式和价值标准,它和地方性的价值、信仰、意义发生遭遇时就可能创造出预料不到的的非正式制度,并由此发现法律可能因为其"制造"的非正式制度而归于失败.从发生于纳西族社会的大量"情死"这一制度悲剧,可认识到法律应中立和宽容地对待社会中的多元价值、信仰、生活方式.

| Abstract: | The numerous cases of "dying for love" found in the Naxi society in the past is a kind of non-formal institution.A study of this can reveal the close relation between the formation of the non-formal institution and law.If the law stipulates the only "correct" lifestyle and value standard,some unexpected non-institution may emerge when it meets with the local values,religions and meanings.Thus,the law may fall through due to its "creation" of the non-formal institution.The institutional tragedy revealed in the numerous cases of "dying for love" in the Naxi society shows that law should be impartial to and tolerant of the multi-values,religions and lifestyles of different societies. |
