| 摘 要： | 从期间制度的现象出发,对不同法系国家刑事办案期间制度进行深入考察,以探究办案期间纷繁表象背后的基本规律,这具有重要意义。英国和法国分别是英美法系与大陆法系的代表国家。整体上讲,办案期间制度设置采取了原则规定型与具体规定型并重的双轨制立法模式。尽管法律渊源传统相异,但是两国期间制度却具有很多共性,同时又存在一些较为明显的差异。
