人大监督司法视野下的执法检查

人大监督司法机关有多种方式，人大对司法机关进行执法检查是人大监督司法机关最重要的方式之一。通过执法检查可以促进法律、法规、司法解释的完善，促进保障政策的实施，解决司法实践中的许多困难，完善司法机关的内部制度，提高审判和检察工作的质量和效率。但当前，人大对司法机关的执法检查采用的检查方式单一，执法检查的立法滞后，依赖被检查单位进行，执法检查过程不够透明、公开，导致监督效果不理想。人大对司法机关的执法检查制度应当不断完善，既要提高执法检查的透明度，又要不断改进执法检查的方式，同时要完善相关的法律法规。

The National People＇s Congress supervises the judicial organs in many different ways, and the law enforcement inspection fection of laws, regulal is one of the most important. The law enforcement inspection can help to improve the per-tions and judicial interpretations, to promote the implementation of security policies, to solve many difficulties in judicial practice, to better the internal system of judicial organs, and to improve the ju- dicial and procuratorial practice quality and efficiency. But the law enforcement inspection by the National People＇s Congress is carried on unitarily, the lawmaking for the inspection is lagged, the inspection is mainly de- pendent on the organ being checked, and the inspection process is not transparent and open to the public. Conse-quently, the supervisory effect is far from being satisfactory. Thus, this inspection system should be improved in its transparency, the methods of inspection as well as in the perfection of laws and regulations concerned.
