对依法规范股票价格的思考

我国的法律虽然有关于股票发行价格的规定 ,但却不全面、不合理。在实践中 ,股票的定价发行是在没有投资者参与的情况下 ,由发行人与有关方面确定的 ,这违反了公平、平等的证券法基本原则。对此 ,应当完善有关的法律、法规 ,增加关于股票发行价格的更加合理、具体的规定。在股票的二级市场上 ,股票的交易价格虽然有日涨跌幅的限制 ,但对于首日上市的股票价格却没有限制规定 ,应当在有关规定中增加相应的内容 ,对首日上市的股票价格也要予以限制。

Thought on Standardizing Stock Price by Law

The regulations on the issue price of stock, although stipulated in relative laws of our country, are yet less sound and reasonable. In practice, issue brokers and relevant organizations without the participation of investors decide the pricing issue of stock; it is contrary to the fair and equal principle of the Stock Act. Therefore, the relative laws and regulations should be further perfected, increasing the rational and concrete provisions on the issue price of stock. Despite daily limit up and down restriction, at secondary markets, there is not any limitation on listed stock price in the day of its issue. Thus, it is necessary to add contents of these aspects to regulations, constraining such problems.
