| 摘 要： | 陪审团制度在实现司法民主、制约国家权力、防止专业垄断、引进非专业视角、软化法律刚性、加强法律规则整体的规范力、提高事实认定的准确性等方面具有重要价值。我国应废除现行参审制 ,结合我国实际 ,引进陪审制。

| Abstract: | Jury system has significant value in achieving judicatory democracy, checking national power, avoiding special domination, introducing non-special view, softening legal rigidity, strengthening the overall effectiveness of rules, increasing the veracity of fact-finding, etc. Our country should abolish mixed courts system and use jury system of Britain and America for reference according to the practice of our country. |
