| 摘 要： | 在国际金融学和国际金融法学界，对《巴塞尔协议》的性质都存有异议。通过对条约要件的剖析，认为《巴塞尔协议》不构成“国际条约”，在巴塞尔委员会成员国之外不是“国际惯例”，而只是一个不具备条约约束力但可能导致国际惯例产生的特殊文件。

| Abstract: | Varied opinions exist in the field of study of international finance and international financiallaws concerning the nature of Basle Agreement. This article,with a comprehensive analysis of the major constituents of the very agreement,proposes that Basle Agreement should not be considered an international treaty and outside member countries, of the Basle Agreement,no international practice exist. Basle Agreement is but a special document which has no binding force of a treaty yet may lead tocertain international practices. |
