| 摘 要： | GATT第XX(b)和(g)条可以成为WTO中除自由贸易领域之外一般领域的环境例外条款,需要满足"必需"和"保护可耗竭的自然资源"以及"非任意或公平的歧视"三个要求.从可持续发展观来看,目前WTO/GATT对"可耗竭的自然资源"的解释符合了可持续发展观,但对"必需"和"有关"的要求过于严格.

| Abstract: | That Articles XX(b) and XX(g) of GATT become environmental exceptions for the commonsense fields other than free trade in WTO's law needs to meet three requirements. That's to say, environmental measures are "necessary" to protect human, animal or plant life or health; environmental measures aim at protecting "exhaustible natural resources" and don't constitute a means of "arbitrary and unjustifiable discrimination". From the sustainable development perspective, WTO/GATT's interpretation of "exhaustible natural resources" embodies the spirit of sustainability, but WTO/GATT have interpreted rigorously such terms as "necessary" and "relating to". |
