| 摘 要： | 鉴定结论作为法定证据形式,在实践运用中出现了因其可靠性不确定而导致的种种问题。通过分析影响鉴定结论可靠性的各种因素,为鉴定结论的可靠性建立了一系列保障程序,包括对检材的收集、提取和送交鉴定的程序;受理鉴定后鉴定机构的操作程序;鉴定人的中立立场;鉴定人资格授予管理机制以及针对刑事诉讼被告人的权利保护,实行为辩护方设立鉴定顾问制度。

| Abstract: | Expert conclusions are one type of legal evidence.During the course of justice,many problems appear regarding to their reliability.Through analyzing different factors that may influence the reliability,the author sets up a series of guarantee measures,such as the evidence collecting,submitting and verifying procedures,the operating procedures of verifying institutions,the neutral side taking of the verifier,the verifier's qualification managing mechanism,the right protection of the prosecuted and the establishment of the verifying advisory system. |
