| 摘 要： | 21世纪以来,台湾地区的刑事司法进行了一系列改革。就整体制度层面而言,台湾地区在借鉴当事人主义具体制度的同时,坚守了大陆法系职权主义的基本特征和主要特色。从扁家弊案入手分析可知,台湾地区在保留大陆法系最重要原则的基础上,作出了具有原创意义的改革尝试,为新时期职权主义自身的发展完善提供了可能的思路,也为我国大陆地区的司法改革起到了借鉴作用。
