摘    要:相对集中行政处罚权制度是我国行政管理体制的创新,这一制度逐步应用到文化领域,标志着我国加大了知识产权保护的力度,行政综合执法体制改革取得了重大突破。本文以上海市为例对此进行了阐述。相对集中行政处罚权的实质是对行政权重新设置和重新调整,即行政权的重构,由一个新的国家行政机关集中行使原来分散行使的行政处罚权。然而,文化领域相对集中行政处罚权制度仍有许多不足,具体表现在试点面过于狭窄、明显的法律滞后性、具体模式有待改进、范围不宜过大和执法队伍不够规范等问题。

Abstract:The open centralized executive penalty power system brings forth the Chinese executive administration.This institution is progressively applied to cultural administration and marks that we will protect the intellectual property more strongly and the breakthrough of administration system.Shanghai is a good example.The essence of open centralized executive penalty power lies in establishing a kind of new executive power.A new administrative organ centralizes executive penalty power which was decentralized before.However,the relative centralized executive penalty power system in the field of cultural administration is deficient,for instance law legging behind,the centralized power going beyond the limit and the administrative enforcement needing to be normalized.
