| 摘 要： | 基于未成年犯罪人的特点和刑罚观的转变,当今世界绝大多数国家和地区对未成年犯罪人都施以特殊司法保护原则,我国也是如此。为了正确贯彻这一原则,实现刑法的双向保护机能,澄清一些片面认识,必须确立罪刑法定理念、双向保护理念和教育为主理念,使对少年犯的特殊司法保护沿着正确的方向进行。

| Abstract: | In the world today, the special judicial principles have been carried out to protect juvenile delinquents in the overwhelming majority of countries and regions on account of natures of juvenile delinquency and view changes on criminal penalty, so it is with China. In order to implement this principle correctly, realize the two-way protecting function of criminal law and clarify some lopsided views, the rationale of a legally prescribed punishment for a specified crime, two-way protection and putting education first must be established. Thus the special judicial protection for juvenile delinquents will progress in a correct direction. |
