证人作证制度的道德维度思辨

证人作证制度是证据法中的重要组成部分,如何提高证人作证率一直是各国立法努力的方向.然而证人本身也是处于复杂的社会关系网中,在道德维度上存在着个体差异,证人制度也应当对这种需求予以考虑.而我国证人作证制度却未考虑到个体的道德需求,只是以一种圣人之德来对证人作证义务予以普遍性的要求.缺乏证人免证特权的规定,也就成为我国制约证人作证率的一个瓶颈.
