| 摘 要： | 沉默权是我国法学界目前讨论的热点 ,其先进性和科学性不容置疑 ,但由于我国传统法律思想的强势作用 ,以及目前严峻的社会治安形势 ,又使得许多人对实行沉默权制度心存疑虑。在综合考虑以上因素的前提下 ,笔者认为 ,沉默权制度应该尽快在我国立法中予以确认 ,但要作出适当的限制 ,并就限制的具体内容提出了自己的建议。

| Abstract: | The right to silence is a hot topic in the field of scholars.Undoubtly,it has the Characteristics of advance and science.But because of the strong effect of Chinese traditional thoughts and the serious situation of the present social security.Many people are doubted about the application of the right to silence.This article focus on the prior factors,gives its suggestion,and believes that the right to silence should be admitted in the legislation limitedly.Also the auther gives his suggestion on how to restrict the application of the right to silence |
