对见义勇为立法的理性思考

当前的社会实践中 ,一方面存在着大量的见义勇为者 ,另一方面又有一些见义勇为者为保护其合法权益而寻找不到恰当的法律武器。针对该情况 ,本文通过四个方面论证了我国亟需进行统一的见义勇为立法 :当前对见义勇为立法的匮乏 ;统一见义勇为立法的必要性 ;统一见义勇为立法的可行性 ;未来《见义勇为公民权益保障法》的框架及其主要内容。

On the Necessity and Feasibility of Unifying LegisIation for Action for Righteous

In recent social practice, there are lots of people who are zealous in doing what is righteous in seeing it, but on the other hand, these people who secure their own legitimate right and interest can not find appropriate law weapons for protecting. According to this social phenomenon, this article will expound and prove the united legislation for doing boldly what is righteous from four aspects, which is very vital in our country. They are the lack of legislation for doing boldly what is righteous, the necessity and feasibility of unifying this legislation, and the framework and main contents of new "guarantee law for citizens' right who act for the righteous". This article is hoped to apply some theoretical reference to Chinese legislation for doing boldly what is righteous.
