| 摘 要： | 以TRIPs框架为基础,从传统知识的含义出发,分析了传统知识和TRIPs的关系,指出TRIPs在保护传统知识方面存在着一定的缺陷,提出应将传统知识纳入TRIPs保护范围,在TRIPs框架下加强国内知识产权立法上保护传统知识的必要途径。

| Abstract: | The relationships between TRIPs and the traditional knowledge are analyzed from the definition of traditional knowledge. It is pointed out that TRIPs is slack in the traditional knowledge protection, and the traditional knowledge ought to be protected within TRIPs. The necessity of strengthening the internal legislation of intellectual property protection under TRIPs, is emphasized. |
