| 摘 要： | 在法治社会中,法律的作用越来越重要,尤其是对于实现人的价值和意义来讲更是如此。而法律的局限性主要体现在立法和司法活动中,并且法律仍存在其不可调整的诸多领域。对法律局限性的克服则需要立法主体和司法主体不断提高自身的素质,另外可以通过建构混合性的司法行为模式来克服法律的局限性的思路。

| Abstract: | The role of law is more and more important in a legal society,especially to the realization of human's value and significance. The legal limitation mainly manifests in the legislation and the judicial activities,and the law still has many domains that can't be adjusted.To overcome law limitation,legislate and judicial main bodies need to improve their own qualities.Besides,complex judicial behavior patterns can be built. |
