A probe into student-injury accident and correspongding legal duty

The student-injury accident involves tort civil liability. According to the rules of the Tort Law, this paper probes the nature of the legal relationship between the school and the involved parts, the liability principle, the liability components. It analyzes the involved parts, especially the limitation of school''s liability. It suggests to implement active prevention principles, to strengthen cadre training and institution construction, to reduce or even eliminate accidents, to deal with damages according to law, to protect the lawful rights of school, teacher and student.
