| 摘 要： | 重新界定了《联合国国际合同使用电子通信公约》的适用范围，提出了该公约的延伸适用及其他可能的广义应用的新理论。论文通过详细分析该公约与其他国际法的关系，发掘了该公约在国际贸易法律体系中延伸性适用这一既往忽视的重要法律问题，揭示了该公约中延伸性适用的法律设计推动电子形式的国际贸易发展的重要意义，阐释了该公约的延伸性适用与参照准用将促进我国跨境电子商务及对外贸易发展的重要价值。

| Abstract: | The paper redefines the scope of application of the United Nations E-Communications Convention and presents the new theory with respect to the Convention''s extensive application and the other possible legal adoption. The paper,through the solid study of the relevant provisions on the Convention''s extensive application, reveals the innovative and unique legal design in the international trade law system, its importance to facilitating the international e-trade and the value for stimulation of the Chinese cross-border e-commerce and foreign trade. |
