| 摘 要： | 民商事关系的复杂性及关联性决定了涉及第三人的情形日益增多,因而选择仲裁解决民商事争议不能回避第三人问题。我国现行《仲裁法》没有确认仲裁第三人制度,对该制度的质疑与回应同时存在。经济新常态下完善仲裁制度、创新仲裁思维势在必行,仲裁第三人制度的确立应有所突破。

| Abstract: | The complexity and relevance of civil and commercial relations determines increasing of the third party. It could not avoid the third party if choose arbitration to solve the civil and commercial disputes. The arbitration third party system has not been confirmated in Arbitration Law of our country; the question and response exist at the same time. Under the new normal circumstance to improve the arbitration system and innovate arbitration thinking is imperative, the construction of arbitration third party system should be a breakthrough. |
