“治安承包”及其对公法私法二元区分的挑战

文章认为,对于“治安承包”现象的出现,应该考查它出现的背景、在现实中遇到的问题,然后才试着从理论上寻找支持或反对它的理据。通过“公共行政”、“公法私法二元区分”两个视角的分析,笔者认为,“治安承包”现象的出现有其一定的现实合理性因素,而且实践证明其在现实中也确实发挥了一定的作用。不应该简单地否定“治安承包”现象。

Public Security Contract and Challenges to the Distinctionbetween Public Law or Private Law

In terms of the emergence of the emergence of the public security contract,we should first review its background and the problems encountered in reality and then find ont the snpporting or opposing basis.From two perspectives of analysis,public adminstration and public law and private law,the author believes that the phenomenon certain reasonable factors,and its practice indeed played a role in reality.Therefore,the author advocates that we should not simply negate the public security contract phenomenon.
