论后乡土中国的法治启蒙

现代性的法律制度打破了中国乡土社会的传统秩序,但由于缺乏法理念的精神支撑,现代法治秩序并未能有效形成,中国社会明显具有后乡土社会的特质。法治视域的后乡土中国不同于乡村中国,它强调的是传统社会对现代国家的认同。今天依赖现代国家的权威推进的法治现代化仍在继续,通过法治启蒙消除传统观念形成的障碍显然十分必要。后乡土中国的法治启蒙,不是观念上的普法教育抑或法治宣传,而是要通过对多元利益的调整来充分的保护权利,通过宪政制度的建设来有效的限制政府权力,以强大的利益召唤力来唤起全社会对法治的认同。

On the Enlightenment of Rule of Law in Chinese Post Earthbound Community

Modern legal system breaks the traditional order of the Chinese earthbound community,but the ruling of law has not been formed effectively for lack of the support of legal idea,so Chinese community clearly has the characteristic of the post earthbound community.The post earthbound community in perspective of rule of law which emphasized the identity of modern state is different from the rural China.As the modernization of rule of law which relies on the authority of modern state goes on,it is necessary to eliminate the barriers formed by traditional community.The enlightenment is not to publicize the law,but to protect rights efficiently by adjusting multiple interests,to limit government power efficiently by constructing Constitutionalism,to evoke the identity of the society for rule of law by strong calling for interests.
