| 摘 要： | 中国古代刑法从理性存在的人性出发,既张扬人的向善能力而肯定刑罚教育主义,又坚持理智败坏人性的"反智主义"而主张刑罚工具主义的惩罚观念;从作为社会存在的人性出发,深入探讨了犯罪产生的社会根源,提出了犯罪预防和控制的综合治理理论;从作为历史存在的人性出发,既树立刑罚的历史权威,又强调刑罚的现实运用.此外,基于"性恶"与"性善"的长期论争,中国古代刑法也深深陷入教化的道德理想主义与刑罚的工具主义的矛盾之中.
