中国传统离婚政策简析

中国传统社会离婚政策的主要特点,涉及离婚政策的理论形态、原则、目标、作用机制及其效果等几个方面。在中国传统社会,制定离婚政策与法律的理论形态是儒学;其原则是限制离婚和性别不平等;目标旨在维护封建父权制及家庭团结;伦理道德与礼教共同调整离婚及两性关系,法律只起到次要和辅助的作用;这种离婚政策带来的直接后果是女性低下的地位以及很低的社会离婚率。

A Brief Analysis of Divorce Policies in Traditional China

The present paper makes a brief analy sis of the chief features of the divorce policies in traditional Chinese society.Such a spects are involved in the paper as th e theoretical pattern,princi-ple,target and function mechanism o f the divorce policies.In such a society,the theoretical pattern for formulating divorce policies an d laws is based on Confucianism while its principle lies on gender inequality and constraints on divorce and its objective on reservation o f the feudal patriarchy and family solidarity.While ethical co des and the laws jointly regulate div orce issues and relations be-tween the sexes,the laws only play a s econdary and supplementary role,which directly results in a low divorce rate,women's disadvant aged status in family and society and their misfortune after di-vorce.
