"法制"与"法治"

“法制”与“法治”是两个容易混淆且在实践中易被人们通用的概念。在党的“十五”大报告中 ,用法治国家代替法制国家 ,以江泽民为核心的党的第三代领导集体首次提出了“依法治国 ,建设社会主义法治国家”的目标。通过这两个概念的历史发展过程、众多思想家的不同观点及自己的理解和认识 ,旨在阐明两个概念的区别和联系 ,揭示依法治国方针的重大意义

"Legal Institutions" and "Rule by Law"

The concepts of "legal institutions" and "rule of law" are different but are often confused in practice. The Report of the Fifteenth National Congress of the Communist Party of China has used "a country ruled by law"instead of"a country ruled by legal institutions." The third generation of the Party's leading group have put forward the aim of "to rule the country according to law, to build a socialist country ruled by law."The thesis expounds the historical courses of "legal institutions" and "rule by law," the different viewpoints among different thinkers and my own understanding about them. In it, relations and the distinction between the two concepts have been clarified and the important meaning of "to rule the country according to law "has been revealed.
