| 摘 要： | 从法理学视角探讨法家思想衰亡的原因,认为在立法思想方面,法家视法律为工具,片面强调法律的作用,失去了赖以存在的社会基础;在法律实施方面,法家思想从重刑厚赏到以刑去刑的转变,无视社会形势的变化;一味推行文化专制,是它走向衰亡的重要原因。分析其原因对当前我国的法治建设具有十分重要的意义。

| Abstract: | The present paper discusses the the reasons of the decline of the legalism Ideology in terms of Jurisprudence.With respect to the legislation,the legalists took law as their tool,attached too much importance to the functions of law unilaterally and of course lost the supportion of people.With respect to the implementation of law,the legalists performed the cultural dictatorship.All the above has the above contributed to the its decline.The analysis of these factors will be significant in building the faw system. |
