| 摘 要： | 学生伤害事故是学校管理中的常见多发事故，如何要正确处理这类事故，其中的关键是确定教育管理关系是学校与学生间的法律关系。在发生伤害事故时，学校按过错责任原则承担相应责任，当当事人均无过错时，法院可援引公平责任原则进行裁量。
