| 摘 要： | 影响力受贿将受贿罪的犯罪主体扩展到国家工作人员之外的“关系密切人”、离退休国家工作人员，由此导致对受贿罪作为职务类犯罪的疑问，进而继发性地引起对本罪保护法益的思考；将“国民对公务行为公正性的信赖”作为受贿罪的保护法益具有现实的合理性，以此为指导扩大“贿赂”的范围实有必要。

| Abstract: | The subject scope of bribery crime has extended the bribery crime to ＂closely related people＂ and retired public staff besides the civil servants, which results in the questions whether bribery is the crime related to the working position only. Further, it touches off some reflections on the protection of legal interests of bribery crime. The reason for ＂popular trust in the impartiality of official acts＂ has been taken as the legal protection of bribery crime, and it is necessary to expand the scope of the bribe, base on the guidance of this theory. |
