论知识产权的法律适用

知识产权的法律适用包括统一实体法的适用和国内冲突法的适用两个层面，前者与加强和促进知识产权的国际保护及其统一化进程的国际趋势相适应；后者与知识产权关系所蕴涵的相关国家的价值取向和政策导向相适应，两者互为补充，相得益彰，舍其一则不能使知识产权的国际协调充分到位。

The applicable law of intellectual Property includes the application of the domestic conflict rules and the uniform substantive rules, which compliment and affect each other. The former is in conformance with the relevant state's value and policy orientation embodied in the intellectual Properly relationship; the latter conforms to tendency to strengthen the international protection for the Intellectual Property and its uniform process. Without either of the two, the international dination of intellectual Property can not be fully realized.
