| 摘 要： | 网络环境下的名誉侵权具有较强的交互性、复杂性、隐匿性特征,因此与传统名誉侵权的构成要件存在着一定差异。网络服务提供商与侵权行为的关联性,使网络环境下的名誉侵权行为具有特殊性。应以其对侵权行为内容的控制力为依据,探究网络服务提供商在名誉侵权中的主体地位及其应承担的法律责任。

| Abstract: | Compared to those traditional reputation tort,the infrining acts in cyberspace featured greatly with the interactivity,complexity and invisibility.And their tight relationships with Internet Service Providers bestow the specificity on it.Therefore,the ISPs＇ subject status should be investigated to determine what liability they should afford judging by their controlling force over the content of defamation. |
