| 摘 要： | 随着网上银行的兴起和发展,如何构建和完善网上银行监管法律制度以对其进行有效监管成为国际社会普遍关注的重大课题之一。巴塞尔银行监管委员会在网上银行业务风险及其监管领域提供了许多可供借鉴的重要原则,发达国家和地区在这一领域的积极探索也提供了许多宝贵经验。本文拟从理论上对发达国家和地区的网上银行法律监管的国际实践进行考察和分析,进而阐明这些网上银行法律监管的国际实践对于全面构建和完善我国网上银行监管法律制度的重要启示。
