未成年人恢复性司法理念的中国实践

未成年人恢复性司法是对传统未成年人刑事司法的反思与超越，实现了司法目的从惩罚到保护的回归。我国也开始进行恢复性司法本土化尝试，基层司法机关运用刑事和解、暂缓起诉、前科消灭等制度处理未成年人犯罪案件，取得了良好的社会效果。在我国试行恢复性司法还需注意观念更新、具体适用制度和配套制度的完善，以期更广泛地发挥该制度的作用。运用“恢复性司法”处理未成年人犯罪案件，既有赖于立法的支撑，更有赖于司法的践行。
