人大代表述职制度实施的要素分析——以W县为例

人大代表述职是在法律规范的原则性要求下，实现选民监督人大代表的制度性创新活动。在对实施该项制度比较成熟的W县进行实地调研后发现，人大代表述职制度的成功创设与实施至少有三个要素：行动者、制度资源和权力关系。其中，行动者特别是作为制度发起者和设计者的人大常委会具有主动拓展行动空间的强烈意愿，在已有的法定权力和制度资源中，人大常委会能够寻求到行动的合法性与合理性，并能妥善处理人大常委会与党委和“一府两院”的权力关系，从而获得了必要的支持和配合。
