| 摘 要： | 法律的要旨是为正常的社会秩序提供有效的保护,为正当的权利行使给予合理的空间,它应当是正义的张扬者,刑法的无限防卫权正是体现了这样的法律精神。对于无限防卫权的认识在学理界有一定的异议,正确认识和把握无限防卫权的价值是刑法理论不可或缺的重要命题。
