| 摘 要： | 混同是债消灭的原因之一 ,是某一具体之债的债权人与债务人合为一体 ,致债的关系消灭的法律事实。互负债务的男女只有在结婚后约定婚前财产为夫妻共同财产才会发生债的混同。在特定情形下 ,为维护第三人的合法利益 ,不产生混同的效力

| Abstract: | Confusion is one of causes to eliminating debts and is to make creditor and debtor of some concrete debt into integration in order to form lawful fact of eliminating debt relation.The debt confusion occurs between male and female after they got married and properties before marriage are decided as their common properties.Under the special condition there is no debt confusion in order to profect the interests of the third party. |
