| 摘 要： | 为维护公共利益,政府可以对公民私有财产进行征用,我国2004年宪法修正案对此进行了明确的规定。紧急征用是紧急状态下的应急措施,可对公民财产权实施必要的限制,但紧急征用也必须遵守补偿的原则。我国相关法律对此规定十分欠缺,为落实宪法的要求,应尽快对其予以完善。

| Abstract: | The revised proposal of Chinese constitution in 2004 clearly stated that in order to preserve the public interest,the government has the right to confiscate the property of citizens.Urgent confiscation,as the measures to meet the urgency,can make the necessary limitation to citizen's property rights,but it should also follow the compensation principles.Due to the lack of the relevant laws in China,it should be improved as quickly as possible in order to meet the requirements of the constitution. |
