黑社会性质犯罪组织的特征及其防范

阐述了黑社会性质组织的定义。指出了黑社会性质犯罪具有雄厚的经济实力;寻求政治保护伞;势力范围逐渐扩大;稳定、严密及暴力性的四个组织特征。提出了完善对黑社会犯罪财产刑的立法,彻底摧毁黑社会性质犯罪的物质基础;加强反腐力度,彻底扫除黑社会性质犯罪的社会基础;建立全方位、多层次的综合防治体系,从根本上铲除黑社会性质犯罪的土壤的防范措施。

Characteristics and defense to mobdom crime organization

This paper demonstrates the definition of the organization of mobdom crime and points out the four basic organic characteristics.That is,the organization of mobdom crime has a profound economic basis;they will try their best to seek the protection from the political field;the reach of their influence is increasingly broadening;their organization is stable,rigorous and violent.The authors put forward several suggestions.Firstly,we should strengthen the legislation of the penalty of possessions of mobdom crime to destroy the material basis completely;secondly,we should fight against corruption more powerfully to destroy the social basis of mobdom crime;last but not the least,we should set up the multilevel protection system to get rid of the basis of mobdom crime.
