论农地征用中的几个关键性法律问题

由于我国农地征用法律制度的粗线条和不完善,使农地征用中的农民利益得不到有效保障。解决这一问题的关键是厘清农地产权的归属,此外,忽视现实存在的商业征地的具体情况而对农地征用补偿费采取“一刀切”,以及征地费用过低、补偿款不能及时到达失地农民手中等现象也必须尽快解决,并以相应的法律制度予以保障。

Some Key Legal Issues on Farmland Acquisition

Because of the rough and incomplete legal system of farmland acquisition,the peasants' interests can not be guaranteed effectively.The key to resolve this problem is to make the ownership of the farmland clearly.In addition,the problem must be solved as soon as possible,such as ignoring the reality of the existence of commercial land acquisition and imposing the compensation on farmland acquisition "broad-cut";and land acquisition costs low;compensation can not be recovered in time to the farmers who lose their land.Furthermore,the relevant laws also must be established.
