| 摘 要： | 法学界对调解的研究比较充分，但对作为调解主体的人民调解员研究不足，个案化实证分析较少。在理论假设上，少数民族聚居地的人民调解员应当具备以下角色特征：法律角色、政治角色、务实角色和民族角色。通过在“台湾村”的实地调研，对该理论预设进行完善，认为理论假设层面还存有信任缺失和角色失衡的缺陷。基于此，对调解法律制度作出反思，并提出相关建议。

| Abstract: | Abstract: Research on mediation system in Law circles is sufficient, while the study on mediator especially for case analysis is less. Hypothetically, mediator in ethnic minority areas should have the following characteristics: legal personality, political role, pragmatic role and the role of minority. Through the field investigation, the theoretical presupposition could be verified. There are defects exited in the presupposition which include lacking of trust and the role of imbalance. Based on this, we rethink the Mediation Law and put forward some suggestions. |
