| 摘 要： | "明刑弼教"学说直接凸显刑罚功能,远不如"德主刑辅"粉饰统治阶级"仁政"的效果,故而在宋代以前难以获得统治阶级的青睐。为强化封建国家的政治职能,朱熹密切关注古代法制体系的具体结构,对儒家传统的"德主刑辅"概念作了新的注解,对"明刑弼教"法制原则作了进一步阐发,添加了诸多新的内涵。

| Abstract: | "Exposing the penalty,combined with Confucianism" directly highlighted the penalty doctrine,far less the effect of "ethics-based,supplemented by the penal code" whitewashed the ruling class"benevolent" and therefore difficult to obtain the favor of the ruling class before the Song Dynasty.In order to strengthen the political functions of the feudal state,Zhu Xi had been paying close attention to the specific structure of the ancient legal system,giving a new annotation of the Confucian tradition "ethics-based,supplemented by the penal code",making a further elucidation of the principles of the rule of law on "exposing the penalty,combined with Confucianism",and adding many new connotation to it. |
